Writ of Replevin: Steps to the Replevin Process
There are generally two stages to the replevin process:
- The Replevy: steps taken by the owner to recover the disputed property. The individual pursuing the case will need to provide security to move forward with the suit and for the eventual return of the property if the case is not ruled in his or her favor.
- A Replevin Suit: In common law, a replevin suit to recover goods wrongfully being held or taken by another party would be considered detinue. The difference, however, is that immediate recovery of property is not available under detinue actions.
