Turnover Order

A turnover order is often used when the property of the debtor is not easily seized or attached in the normal legal process, and there is no other way to meet the terms of the judgment. The debtor will have to hand over any property that is not exempt. The judgment holder is allowed to obtain all assets that are available. This order can be put in to place even before the other remedies have been completed.

When filingĀ for a turnover order, make sure to list specific property. It will not work if you simply state “debtor is to turn over all cars in his/her possession”, you need to specify the exact cars including make, model, and licenseĀ plate number. Turnover Orders can be difficult to obtain and require a search for hidden assets before they can be filed.
